What happens now, Activison will buy it Battlezone rights back from atari?

Bankrupt companies can still sue for use of their IP (coprights, trademarks, etc)

No, when bankrupt, there's usually a sale of assets to pay creditors. For example, here's what happened at THQ's bankruptcy auction today.
Buying the rights to the Battlezone name would be nice, but I don't see Activision doing it (they probably lost money on BZ2 and they're a console-centric publisher outside of their Blizzard arm). And anyone who bought the name Battlezone would have to negotiate with Activision to see any BZ1/2 source code. Why see the source code? Because BZ1/2 fans have proven amazingly intolerant of any changes. Sad, but true.
