The First Amendment and Constitution allow every citizen of the United States total religious freedom; freedom to practice religion or irreligion as they choose. Forcing a kid to go to a church (the "his church" point I've already discussed in the previous post; it may be considered "his" church even if he doesn't attend or doesn't believe) is a violation of his religious freedom.

So I don't really see how that is semantics.

he's still worshiping the way he chooses, but the judge is giving him the choice - that or go to prison.

Even if it is a church he normally attends, what the judge has done is still illegal. Forcing anybody into religious action - whether it would be their choice or not - is illegal.
